Introduction

Valida Aktien (hereinafter "the Company") regards confidentiality and the privacy of our clients' data as a primary concern. We store and process the information we receive from our clients on computer systems that are protected by up-to-date security measures.

We will neither sell nor rent your personal information to third parties for any purpose without your consent, as set out in the Terms of Service Agreement. Your personal data will be used solely in accordance with this Privacy Notice and with the provisions of the Terms of Service Agreement.

Information about the Data Protection Act 2018 and the General Data Protection Regulation (the "GDPR") is also available on the website of the Information Commissioner.

Your Rights Under the GDPR

Under the GDPR your individual rights in relation to your personal data are as follows:

  • the right to be informed about the personal data being processed;
  • the right of access to that data;
  • the right to rectification;
  • the right to erasure;
  • the right to restrict processing;
  • the right to data portability, that is, to receive an electronic copy of your personal data;
  • the right to object to the processing of your personal data; and
  • the right not to be subject to automated decision-making, including profiling.

Personal Data Obtained From a Client May Include

  • Data provided in applications, questionnaires and account-opening forms: full name, permanent address, citizenship, date of birth, passport details, email address and personal mobile number.
  • Documents provided as proof of a transfer of funds: transfer orders, bank statements, copies of a credit card and comparable records.

Privacy Practice

The Company may use a client's personal data:

  • as proof of identity;
  • to process the client's operations;
  • to inform the client of an expansion of the range of products and services provided by the Company;
  • to provide other services.

Third Parties

The Company has the right to provide a client's personal data to third parties, namely affiliated companies, banks, auditors and agents of the Company, including paying agents and others (hereinafter "Third Parties"), solely in order to fulfil the terms and conditions of the Terms of Service Agreement. The Company guarantees that Third Parties will adhere to this Notice and will take appropriate measures to maintain the confidentiality of a client's personal data.

The Company also has the right to provide Third Parties, other than trustees, with confidential information relating to a client's personal data where an official request has been issued by an authorised body.

How Do We Secure Your Personal Data?

We maintain robust procedures within our business:

  • to protect data against accidental loss;
  • to prevent unauthorised access, use, destruction or disclosure;
  • to ensure business continuity and disaster recovery where required;
  • to restrict access to personal information;
  • to conduct privacy impact assessments in accordance with the law and with our business policies;
  • to train staff and contractors on data security; and
  • to manage third-party risk through the use of contracts and security reviews.

Retention

As provided by Article 5(e) of the GDPR, personal data shall be kept for no longer than is necessary for the purposes for which it is processed. Where an anti-money laundering or other legal obligation requires a longer retention period, that period applies.

The Right to Complain

The client has the right to file a complaint with the regulatory authorities if the client considers that the rights conferred by this Notice have been violated by the Company.

Consent for the Use of Personal Data

What are your rights?

  • You have the right to request information on, and access to, the personal data we hold about you.
  • You have the right to request that we correct or delete any incomplete, incorrect, unnecessary or outdated personal data we hold about you. However, we cannot delete personal data that is necessary for compliance with a binding legal or regulatory obligation, that must be retained under applicable law, or that is required for the exercise or defence of a legal or regulatory claim.
  • Where you consider the personal data we have collected to be inaccurate but do not wish it to be deleted, where we have used your personal data unlawfully, or where you have objected to the processing and the existence of legitimate grounds for processing is still under consideration, you may request the restriction of processing of your personal data.
  • You may at any time object to your personal data being processed for direct marketing purposes, for the sending of promotional material, for profiling, or for the performance of market research.
  • Where your personal data is processed on the basis of your consent, you have the right to withdraw that consent at any time.

If you wish to exercise any of the rights set out above, you may do so, as appropriate and in accordance with applicable law, by contacting us through the contact points referred to in our marketing materials or below in this Notice. In some cases, in particular where you ask us to delete your personal data or to cease processing it, this may mean that we are no longer able to continue providing our services to you.

Please note that we may need to identify you and to request additional information in order to fulfil your request, and that applicable law may contain restrictions and other provisions relating to the rights described above.

Subject Access Rights

You have the right to obtain a copy of, and details of, the personal data held about you. To obtain a copy of the personal data Valida Aktien holds about you, please write to us at [email protected]. No charge will normally be made by Valida Aktien for providing this information. Where a request is repetitive, wholly unfounded or excessive, we are entitled to charge a reasonable administration fee.

Scope and Duration of Consent

By registering an account with the Company and/or by using any service provided by the Company, the client agrees to the use and processing of their personal data in accordance with the provisions of the Terms of Service Agreement and of this Privacy Notice for the whole period of validity of this consent.

This consent is valid for the whole period of validity of the Terms of Service Agreement between the Company and the client and for one year after the termination of that Agreement, or until the consent is withdrawn by the client, whichever occurs earlier.

Cookies

The client agrees that cookies may be used on certain pages of the Company's website in order to provide all clients with quicker and more convenient access. If the client objects to the use of cookies, most modern web browsers offer an option to decline them while still allowing full access to the Company's website.

Marketing Communications

At Valida Aktien we take your privacy seriously and will use your personal information only to administer your account and to provide the products and services you have requested from us. From time to time, however, we may wish to contact you with details of other services or competitions that we provide. Where you consent to being contacted for that purpose, you may indicate the channels by which you would like us to contact you: post, email, telephone, text message or automated call.

We may also wish to pass your details to other, well-defined categories of company which are our partners, so that they can contact you by post with details of offers, services or competitions that they provide. Your details will be passed on for that purpose only where you have consented to it.

Withdrawal of Consent

The client is informed that this consent may be withdrawn at any time by sending a clear and explicit notification of withdrawal to [email protected]. In that case the consent is deemed to be withdrawn immediately upon receipt of the client's notification by the Company.

The client is further informed of the right to file a complaint with the regulatory authorities if the client considers that the rights conferred by this consent have been violated by the Company.
